This 2-Day workshop will explore the intricacies of Search Warrants from beginner to advanced levels. After receiving the foundational instruction, each attendee will become the affiant (author) of a search warrant in the practical application component. This workshop will establish a skill set to be successful when preparing and executing any type of search warrant.
Day One – Building a Foundation:
Day one will focus on the understanding search warrants including all elements from establishing probable cause to understanding the administrative and associated legal issues and requirements. The topics include the various types of warrants and the associated Penal Code requirements, CEPCA (SB 178), the probable cause standard, descriptions of persons, places & things, types of endorsements, expertise (Hero Sheet), documenting seized items and warrant returns.
Day Two – Becoming the Affiant:
Day two is the culmination of the topics learned on day one. Each attendee with will prepare a search warrant and affidavit. The importance of articulation will be evident as the search warrants will be reviewed and evaluated. The purpose of the practical application is to make each attendee proficient in preparing search warrants and to build a strong associated case while minimizing liability to themselves and their departments.
Each attendee will receive a Flash Drive with a SW Manual, templates and legal terminology.
